Terms of Service

1. Acceptance of Terms

By accessing or using Fluengo AI (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions herein, you may not access or use the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or guardian.

3. Acceptable Use

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. Specifically, you agree not to:

  • Use the Service to generate or distribute harmful, abusive, defamatory, or illegal content
  • Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service
  • Use any automated system, including robots, spiders, or offline readers, to access the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any aspect of the Service

4. Subscriptions & Payments

Fluengo AI offers both free and premium subscription plans. When you purchase a subscription, you agree to pay all fees and applicable taxes. Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time through your account settings. Refunds are handled on a case-by-case basis in accordance with applicable consumer protection laws.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Fluengo AI and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Fluengo AI. You retain ownership of the content you create through conversations on the platform.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Limitation of Liability

Fluengo AI provides the Service on an “as is” and “as available” basis without warranties of any kind. We do not guarantee that the AI-generated feedback will always be accurate or appropriate for every learning context. In no event shall Fluengo AI be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Fluengo AI operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
