Terms of Service

1. Who You Are Contracting With

Fluengo AI (the "Service") is operated by Usman Javed ("we", "us", "our"), a sole proprietor trading as Fluengo AI. By accessing or using the Service you enter into a binding agreement with Usman Javed. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation. If you are an individual, you confirm you are at least 13 years old (and have parental consent if under 18).

2. Your Account

You must provide accurate, current, and complete information when creating an account and keep it updated. You are responsible for safeguarding your credentials and for all activity under your account, and must notify us immediately of any unauthorised use.

3. Acceptable Use

You agree not to misuse the Service. In particular, you must not:

  • Use the Service for any unlawful, fraudulent, abusive, or deceptive purpose, or to send spam
  • Infringe the intellectual property, privacy, or other rights of any person
  • Upload malware, probe, scan, or test the vulnerability of any system, or otherwise interfere with security
  • Scrape, crawl, or use any automated means to access the Service outside of permitted APIs
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell, sublicense, or redistribute the Service or circumvent any technical limits or quotas

4. AI-Generated Content

The Service uses generative AI to provide language tutoring, conversation practice, grammar feedback, and related outputs. You are responsible for the prompts and content you submit, for how you use any outputs, for verifying their accuracy, and for ensuring you have the rights to any content you input.

You must not use the Service to generate illegal content, hate speech, harassment, sexual content involving minors, deepfakes designed to deceive, malware, instructions for violence or weapons, or to jailbreak or otherwise circumvent the Service's safety measures.

AI outputs may be inaccurate, incomplete, or unsuitable for your purpose. The Service does not provide professional advice (medical, legal, financial, or otherwise) and outputs should not be relied on as such without independent verification. We may filter, restrict, or refuse outputs, and remove content or suspend accounts that violate these terms. As between you and us, subject to our underlying rights in the Service, you retain ownership of your inputs and the outputs generated for you, to the extent permitted by law. If a rights holder believes content on the Service infringes their rights, they may contact us at legal@fluengoai.com; repeat infringers will have their accounts terminated.

5. Subscriptions, Payments & Refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment terms, billing frequency, taxes, currency conversion, cancellations, and refunds are governed by Paddle's Checkout Buyer Terms. Subscription plans renew automatically at the end of each billing period until cancelled. You can cancel any time from your account or via paddle.net; cancellation takes effect at the end of the current billing period.

6. Intellectual Property & Licence

The Service, including its software, design, branding, and documentation, is owned by Usman Javed and its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service in accordance with these Terms and your selected plan. You grant us a limited licence to host, store, and process your content solely to operate and improve the Service.

7. Warranties & Liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that AI outputs will meet your expectations.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the fees you paid us in the 12 months before the event giving rise to liability and (b) USD 100. We exclude liability for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.

You agree to indemnify and hold Usman Javed harmless from claims arising from your content, your use of the Service, or your breach of these Terms.

8. Suspension & Termination

We may suspend or terminate your access to the Service, with or without notice, for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious violations of our acceptable use rules. You may stop using the Service at any time. On termination, your right to use the Service ends; we may delete your account and content after a reasonable period. Sections that by their nature should survive termination will survive.

9. Governing Law & Disputes

These Terms are governed by the laws of Usman Javed's country of residence, without regard to conflict-of-law principles. Disputes will be resolved by the competent courts of that jurisdiction, save where mandatory consumer protection laws of your country of residence apply.

10. Changes & Contact

We may update these Terms from time to time. If changes are material we will give reasonable advance notice. Continued use of the Service after changes take effect constitutes acceptance. Questions? Contact us at legal@fluengoai.com.
